DraftKings Faces Legal Challenge Over Florida Sports Betting Operations

The Seminole Tribe has initiated legal action against DraftKings in Broward County, claiming the company is engaging in unlicensed sports betting in Florida. They argue this violates their exclusive rights established under the state’s 2021 gaming compact.

This lawsuit places significant legal pressure on DraftKings, as the Tribe, which operates Hard Rock Bet, seeks an injunction to halt the company's activities in Florida. Additionally, they are demanding restitution for profits garnered from these operations along with their legal expenses.

Tribe’s Claims Target DraftKings’ Offerings

The 72-page complaint asserts that DraftKings’ platform in Florida resembles its licensed sportsbook platforms in other states. According to the Tribe, the user experience and functionality of the Florida version do not differ substantially from traditional sports betting, regardless of how it is marketed.

Central to the complaint is DraftKings’ Super App, which integrates sports betting, prediction markets, and casino games. The Tribe also disputes the legality of college-sports prop bets and criticizes the platform for not ensuring users meet the minimum age requirement of 21.

As part of their legal strategy, the Tribe reportedly aims to divert any restitution or profits reclaimed toward public-interest initiatives, such as consumer protection and resources for problem-gambling prevention and treatment.

The Tribe's complaint highlights DraftKings' promotional strategies as evidence of the gambling nature of their products. They contend that the marketing for bonuses and help resources contradicts the portrayal of their Florida offering as merely predictive.

DraftKings Challenges the Allegations

In response, a DraftKings spokesperson asserted to local media that their prediction markets are compliant with existing laws. They characterized Pick6 as a peer-to-peer fantasy sports experience focused on individual player performance rather than sports betting, expressing confidence in their legal standing.

The crux of this dispute hinges on whether DraftKings' products in Florida should be classified as fantasy or prediction offerings, as they have claimed, or classified as sports betting, as alleged by the Tribe. A ruling in favor of the Tribe could force DraftKings to modify or cease its products unless they secure a legal pathway for operation in the state.

This case adds to ongoing legal challenges facing DraftKings, although the Florida lawsuit uniquely underscores the Tribe's claim to exclusive rights to sports betting within the state.

Legal Framework Under Scrutiny

The 2021 Seminole Compact delineates the framework granting the Tribe exclusive sports betting rights in Florida. Previous challenges to this compact have been unsuccessful, as reported by Florida Politics, suggesting a strong legal foundation for the Tribe. However, this history doesn’t definitively resolve whether DraftKings’ current offerings violate state laws.

Florida's gaming regulations have experienced numerous disputes regarding the extent of tribal authority and state permissions. The focus here, however, is on whether DraftKings’ products—marketed as predictions or fantasy contests—fall within the parameters set by state sports betting laws.

This lawsuit is being interpreted as a critical test of how online prediction-market products can coexist within Florida's sports-betting regulatory framework. Other platforms, such as Kalshi and Polymarket, have similarly blurred the lines between event-based trading and state gambling regulations, raising further questions about their legal status, independent of DraftKings' situation.

Court Proceedings Ahead

Currently, the complaint filed in Broward County requests a court order to cease DraftKings’ Florida operations, but a hearing date or any immediate court actions have not yet been made public. As of now, the timeline for any developments remains uncertain.

Florida Governor Ron DeSantis commented that while he hadn't reviewed the complaint, the compact contemplated the Tribe’s capacity to offer sports betting. The court will now examine both the Tribe's claims and DraftKings' defense as this legal dispute unfolds.
