Swish Analytics Entangled in Legal Disputes with OddsJam, OpticOdds, and RotoWire
Swish Analytics is currently navigating a complex web of legal challenges, marked by fresh lawsuits from both OddsJam and OpticOdds, along with a separate complaint from RotoWire. These developments have escalated an ongoing conflict over sports betting data and alleged improper data scraping.
The initial litigation commenced in December 2024, when Swish filed suit against OddsJam and OpticOdds, claiming that the companies unlawfully replicated and distributed its proprietary betting odds, asserting damages exceeding $100 million. This accusation has been met with staunch denials from the defendants, resulting in a prolonged legal engagement in San Francisco Superior Court.
Recent filings by OddsJam and OpticOdds have broadened the scope of litigation, introducing allegations against Swish for violating California antitrust laws and engaging in unfair business practices. At the same time, RotoWire's independent lawsuit centers on accusations that Swish improperly scraped and utilized its player news and injury data in commercial applications.
OddsJam and OpticOdds Counter with Antitrust Claims
In their cross-complaint, OddsJam and OpticOdds allege that Swish Analytics' practices contravene California's Cartwright Act, including charges of trade libel and intentional interference with economic advantage. Their argument hinges on the assertion that Swish's pricing strategy unfairly suppresses competition by providing the same odds algorithm to multiple sportsbooks.
From their perspective, this model diminishes the diversity of odds available to bettors, making it challenging for sportsbooks to compete on pricing. The lawsuit stipulates that Swish's actions decrease market competition, to the detriment of both operators and consumers.
Gambling.com Group, which recently acquired both OddsJam and OpticOdds, publicly voiced criticism of Swish's lawsuits. Co-founder Charles Gillespie described the legal action as 'hypocritical,' claiming it has inadvertently forced their companies into a defensive position.
This litigation has not gone unnoticed on social media, with Gillespie remarking, “The lawsuit from Swish may go down as the single biggest own-goal in the history of the online gambling industry. We didn’t pay attention to Swish until they compelled us to.” He clarified that initial attempts at resolving the conflict amicably were ignored, prompting legal recourse.
RotoWire Accuses Swish of Scraping Proprietary Data
Following OddsJam and OpticOdds, RotoWire has also leveled accusations against Swish Analytics. The fantasy sports publisher contends that Swish unlawfully scraped its proprietary sports data, claiming that this information is vital for generating accurate player prop odds.
According to a statement from RotoWire, “Our player injury data is the lifeblood of player prop odds making,” highlighting the importance of their information in the competitive landscape of sports analytics. RotoWire alleges that despite repeated requests for licensing the data, Swish chose to use the information without permission, effectively “free riding” on the hard work that RotoWire has built over the years.
The complaint specifies that Swish's products rely heavily on the unauthorized collection of data, including public admissions from Swish executives regarding their data gathering practices. RotoWire's lawsuit seeks both damages and court orders to prevent further unauthorized use of its data.
This situation is complicated by RotoWire's documented history of investing substantial resources into developing reliable sports information, a process it claims has been undermined by Swish's actions. With Swish publicly acknowledging using RotoWire data without appropriate rights, the stakes have significantly heightened.

As it stands, Swish Analytics is embroiled in three distinct lawsuits that each challenge different aspects of its business practices.
